Terms of Service

Ostra is a subscription website service. We design and build a custom website for your business, host it on our infrastructure, and keep it online and up to date for as long as your subscription is active. This is not a one-time project: the monthly fee covers ongoing hosting, edits, and maintenance.

• One-time setup fee: $500 CAD. Charged at checkout. Covers the initial design, build, and launch of your site. Non-refundable once design work has started, which begins as soon as you submit the intake brief.
• Monthly subscription: $20, $49, or $99 CAD depending on plan. Billed in advance each month via Stripe. Non-refundable for the current period.
• All amounts are in Canadian dollars unless stated otherwise.

The setup fee is non-refundable once design work has started. The current month's subscription fee is non-refundable. If you cancel mid-month, your site stays online through the end of the period you already paid for, and you are not billed again.

If you believe Ostra has not delivered the service described in these terms, contact hello@ostra.studio first. We will work to make it right before any chargeback.

Cancel at any time from your account page on ostra.studio (the link is in your Stripe receipt email and on /account). Cancellation takes effect at the end of your current billing period. You will not be charged again after that. There is no phone tree, no retention call, and no requirement to email us.

Your site stays fully online for the rest of the billing period you have already paid for. After that period ends:

• Your site goes offline. The custom domain you point at Ostra hosting will no longer load the site. Ostra hosts your site under an active subscription; without one, hosting is not provided.
• We keep your project files for 60 days. If you resubscribe within 60 days of going offline, your site comes back online on the same domain with the same content. Nothing is lost.
• After 60 days, the project is archived and deleted. If you want to come back after that, you can sign up again and we will start a fresh project at the standard rates.

Your domain name (if registered in your own name with a third party like GoDaddy, Namecheap, or Cloudflare) is always yours and is unaffected by cancellation. You can point it wherever you want.

You own your business's brand, content, copy, and any photographs or assets you supply. You own your domain. We provide the design, the codebase, the hosting infrastructure, and the ongoing maintenance work. The codebase and the hosting are part of the subscription service; they are not transferred to you as deliverables.

Ostra reserves the right to display a non-confidential summary and screenshots of completed projects in our own portfolio and case studies, unless you ask us not to in writing.

Hosting is provided through reputable third-party infrastructure providers. We make commercially reasonable efforts to keep your site online, but we do not guarantee 100 percent uptime. If downtime exceeds 24 consecutive hours due to our negligence, we will credit one month of subscription fees to your account.

Each plan includes a set number of edits per month or per quarter. Edit requests are submitted by text or email and are completed within five business days of receipt during normal weeks. Plans differ in the number of edits included. Additional edits beyond the plan are billed at $75 CAD per hour, agreed in writing before work begins.

Ostra's liability for any claim arising from these terms is capped at the total fees you paid in the twelve months before the claim. We are not liable for indirect, consequential, or incidental damages, including lost profits, lost revenue, or lost data.

If you dispute a charge with your bank or card issuer, please contact hello@ostra.studio first so we can address the issue. Chargebacks filed without first attempting to resolve a dispute may be contested using these terms, your intake brief, hosting logs, and proof of service delivery. Where a chargeback is initiated for a service that was delivered, Ostra reserves the right to suspend service to the account.

We may update these terms from time to time. Material changes will be sent to you by email. Continued use of the service after a change means you accept the updated terms.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute that cannot be resolved between us will be settled by the courts of Ontario.
